Hi,
I too have the same question. Isnt EAD a non-immigrant status unlike H1B? So, how can one apply for GC on a non-immigrant status? I might be wrong though.
>> Isn't EAD a non-immigrant status unlike H1B?
EAD is not a status. EAD is just Employment Authorization Document. I-485 pending (AoS Pending) is the status.
>> So, how can one apply for GC on a non-immigrant status?
GC can, also, be applied for someone who is not even in US. Kind of status in US has nothing to do with GC process, as long as one is in valid (authorized) status.

My EAD expires on 07/28/2010. My EAD renewal is currently pending (applied online on 5/18/2010 at NSC). My AP expires on 08/24/2010. I am planning to apply for AP renewal once I finish my move to new address.
So, I really don't know which date to put. BTW, USCIS online application didn't mark that field as required.
Put the latest date ( AP ) . May be you can indicate that you are on AOS.

You are on AOS PENDING status. Since u've a valid H1 stamped in ur passport, you are free to roam in-and-out of the country without any issues.
Your H-1 will be invalid until your 485 is approved or you use EAD to work or AP to re-enter US.

Hi,
I am planning to apply my Green card. However I am a bit confused which category will I fall to ? EB2 or EB3 ?
As per my job requirement details, it is as below:
i ) Bachelor degree in technology related field.
In the detailed experience seeked, it says as below:
i) Five years of experience with installing, maintaining servers.
ii) Three years of practical experience in routing and network security.
I have more than 5 years of working experience (which they seeked) before I started this job.
Under which category will it fall under, EB2 or EB3 ?
Thank you

My cousin has I-20's from Universities A and B.he got F1 Visa with University A's I-20.
He is in India and he wants to go to University B.
Could anybody tell if he can directly go to University B and complete the transfer process from there? or does he need to go to University A, complete the transfer process and then go to University B?
does it create any problems at Port of Entry ?
PS: I have not started GC process yet. So, I didn't update my profile.

Hello,
The original labor approval is lost by Attorney, how ever he has the copy of the approval. He says we can file I-140 with copy. Any one has had this situation ? What is your experience doing this ?
Thank You

Employer can revoke 140 but as 180 days have passed you will have to demonstrate to USCIS that your 140 would have been approved with the new company if it was filed. That is somewhat not very straightforward so my suggestion is that you should take your employer in confidence so that 140 is not revoked......
AC21 - Job title can be different but job duties have to be similar. Similar duties are a MUST to avoid any issues with AOS.......also you dont have to inform USCIS that you changed your employer........there are pros and cons of it but what I have seen is that most people do not infrom USCIS......when USCIS comes to a point that they will adjust your status they might check with you if you are working with same employer and issue a RFE which you can respond to easily with the help of an attorney (just hv to make sure that job duties are similar and the new employer will issue you a letter which will prove it)
Make sure that you talk to HR and your manager if you take up a new job to acertain that job duties match, run both job descriptions by your attorney......better to take precaution than to be sorry.

I have a curious situation. I have filed EB3-485 as a secondary applicant to my wife. I am currently in a job where I can't file a green card ( this is my 5th year of H1b). My understanding is one can't have a seventh year extension for H1b unless his I-140 is approved.
Should I consider changing the job and filing another GC by myself. I know I can continue renewing EAD but I still want to keep my H1b
Thanks
If you want to keep your H1-B beyond 6 years, I dont think you have any other option! You have to have your own LC>365 days or approved I140.

Looks like CIR has a rough road ahead:
From immigration-law:
06/14/2006: AILA Reports Anti-Immigrant Calls to Congress Outnumbers Pro-CIR at 400:1
* AILA has reported that immigration restrictionists are flooding Congressional phone lines and email inboxes with angry demands that their Senators and Representatives vote against any legislation that provides a path to citizenship for undocumented immigrants. Their calls for an enforcement-only immigration policy are reportedly louder and more aggressive than ever and there are 400 of them for every 1 call from proimmigrants. AILA is concerned that the 400 to 1 intensity of the opposition to comprehensive immigration reform (S. 2611) is expected to crescendo into the November elections, making it a likely voting issue at the polls.
* Considering the fact that most seats in the House are up for grab in the November election, these anti-immigration forces pose a powerful threat and road block to meaningful enactment of comprehensive immigration reform legislation.
* These anti-immigration forces also appear to use a strategy to weaken the pro-immigration forces by inducing the immigrant community more and more divided between the legal and illegal immigrant communities and pushing them further and further antagonistic each other by spreading rumors that illegal immigrants would take away employment-based immigrant quota from the legal immigrants and the legal immigrant community should oppose the comprehensive immigration reform legislation as passed by the Senate. "Divide and Conquer" strategy appears to work for these immigration restrictionists.

AR-11 has to be filed by all non-citizens, that translates to GC holders or permanent residents as well.
You dont have to provide COS for I-140 if all correspondence is going to your employer and you dont have any other pending application

Moon mission is quite a technological jump! As per APJ, it all starts from looking into the sky and dreams....imagination, creativity.....
American dream is also lots of ups and downs....
Indians in IT and NASA are products of those dreams....
Nuclear cooperation between India and the US would change energy, infrastructure and development equations fundamentally...
All of the above impact us fundamentally as well.
Why STOP this thread as long as the context is technology, our future and life in 21st century?

I was in a similar situation back in 2000. The difference (in my case) was I entered 2 weeks later than the date mentioned on my I-20.
I took the chance and applied for re-instatement - at that time, I think it cost me $175.
I got my application approved in 28 days...!
Good Luck 'n don't be skeptical. Just apply to be re-instated and you will be fine!!!

Please while protesting, Try to position yourself in ways where the society will accept you. I took sociology and learnt a great deal and I feel minorities need to find a common ground and establish themselves with a new society. Please do not make them detest us or bully us in anyway. The racial slur will hurt our Commitment toward fair immigration. Mexicans brought US flags and acted like they are " them" - the common people of USA. We should win hearts by CONNECTING WITH CULTURE and SOCIETY WHICH WILL BE HOME FOR US IN YEARS TO COME.
COME CASUAL. WEAR CLOTHES THAT PEOPLE IDENTIFY YOU WITH. FIND WAYS A COMMON AMERICAN MAN CAN UNDERSTAND YOUR SENTIMENT. I AM POSITIVE THIS WILL WORK. IT CREATES UNDERSTANDING THROUGH ESTABLISHING SIMILARITY.
GO WELL DRESSED, WE ARE EDUCATED. WE ARE SMART. MEN NICELY SHAVEN, GOOD CLOTHES - THAT RELATES WITH SOCIETY. AND FANTASTIC SLOGANS. CATCHY AND BOLD. RIVETING AND CAPTURING.
Thank you. Hope it helps. A new perspective is always refreshing and glad I am able to bring to you my sociological perspective from AMERICAN school.
PS: I know some may disagree and that is fine too. But what I feel is, we are bullied sometimes you know as " curry" "smelly indians", Dirty hindus because we slack at times and take things lightly but as minorities we need to understand we have to work harder to go into the threads of American society but at the same time keeping our values and principles in place. STAND UP AND FIGHT FOR PROSPERITY AND JUSTICE. PREVAIL THE JUST.
PUT IT SIMPLY : MY WISH IS WHEN COMMON AMERICAN PUBLIC LOOK AT US, THROUGH THEIR TELEVISIONS OR WHATEVER FORM, THEY MUST FEEL " WE NEED THEM, WHAT A WONDERFUL COMMUNITY" AND THAT COMES THROUGH ETIQUETTE AND GOOD PUBLIC PROJECTIONS BOTH PHYSICAL PROJECTIONS AND OUR EMOTIONAL FRAME WHICH REFLECTS OUR INTELLECT AND WHERE WE CAME FROM. NO MORE BLOODY,SMELLY TAGS TO US. LET US SHOW THEM WE ARE TOO FORWARD THINKERS AS THE WESTERN SOCIETY!!

I tried it. They might wont ask new approval notice. You should show that and get the expiry date in I-94 as same as your latest I-797 Approval notice.
You don't need to stamp visa as its not expired.....
Have a nice trip to India.
